What is a Subdivision?
A subdivision can generally be described as the legal mechanism that leads to the creation of new parcels of land. Subdivision involves the division of land into two or more parcels, and can also include the re-alignment of existing property lines, the creation of strata lots, and the creation of building strata’s. The Land Title Act authorizes a City Council to appoint a person (approving officer) to independently administer the approval or rejection of a subdivision application and in this role, it is the approving officer and not City Council who acts in a judiciary manner, and approves or rejects a subdivision application. In some incidences the plans may not require approval and these include plans that consolidate whole parcels, lot line cancellations and some building strata. The Approving Officer will consider existing city policies, such as the Official Community Plan, policies set by Council, and zoning regulations, such as lot size, lot dimensions, servicing, frontage, density and use, setbacks, access/mobility, parks, environmental protection, and hazards, before providing a decision.
Types of Development
Subdivision: (Fee Simple): A subdivision application is made when the applicant wants to create two or more properties from one or more existing parcels, adjust or re-align an existing property line, or consolidate two or more properties into one lot.
Bare Land Strata Subdivision: A bare land strata subdivision is to create strata lots within one parcel of land where owners have joint ownership over the common lands and individual ownership of strata lot.
Building Strata Subdivision: A strata development is a development where the building complex is divided into multiple units, with all unit owners having joint ownership of the comment elements and separate ownership of their individual units.
Phased Building Strata: This is an application for a strata complex that is built out over several phases.
Strata Title Conversion of Existing Dwellings: This is an application for conversion of an existing dwelling (e.g. apartment building) to strata titled ownership of individual units
You may wish to present your proposal to the Development Review Commiteee before submitting your formal application. The Development Review Committee is made up of various departmental staff members and meets every two weeks. This provides an opportunity for applicants to present a development proposal and discuss with staff the feasibility of the proposal before submitting formal applications.
